TERMS AND CONDITIONS OF USE OF UTRANSFER
These Terms and Conditions of Use constitute the agreement for the use of the Platform called “Utransfer”, which is owned by Innovation & Technology Services ITS – LLC, hereinafter referred to as “The Company”. These terms and conditions will be accepted by forming a bilateral agreement regarding this document, as a prerequisite to continue with the procedure to be admitted as a user and make use of Utransfer. The parties freely and voluntarily agree to enter into this agreement obliging them to comply with the provisions contained in this document:
BACKGROUND
“The Company” is established and domiciled in Puerto Rico. It is the owner of the platform “Utransfer” and the exclusive owner of the information contained therein. It is also the exclusive holder of the intellectual property rights of “Utransfer”, which allows for online transfers, purchases, and payment for basic services, thanks to its technology platform integrated by the user-friendly Mobile Application. The creation and access to private accounts for registration, management, and storage of account information.
GENERAL TERMS COPYRIGHTS AND TRADEMARKS:
All content is the property of “Utransfer”. All copyrights and trademarks are reserved. The User acknowledges and agrees that “The Company” is the legitimate holder of the intellectual and industrial property rights over “Utransfer” and over the various means used for the presentation of the contracted service, such as computer programs, databases, procedures, undisclosed information, distinctive signs, advertising information, among others, means that are therefore protected by the current Intellectual and Industrial Property laws and international agreements. Consequently, the User agrees not to modify, lend, rent, sell, distribute, decompose, copy in whole or in part, or in general use and/or exploit for commercial purposes any information or means employed in or for the presentation of the service, including all that is available on “Utransfer” or in any related place and/or with the presentation of the service, whether owned by “The Company” or by third parties related to them.
CONTENT
All text, information, data, photographs, graphics, HTML code, informational software, source code and object code, audio and video samples, brands and logos, and similar (hereinafter referred to as “Content”) that appear on this mobile-optimized website, mobile device services or mobile device applications (collectively “Mobile Application”) and computer webpage belong to INNOVATION & TECHNOLOGY SERVICES ITS- LLC (hereinafter “The Company” or its affiliated companies). Users (as defined in this document) may only use the Content on a mobile device (for example, Apple iPhone or iPad, Android device or mobile device with Microsoft Windows) that they own or control, and only for personal, internal reasons and not for commercial purposes. INNOVATION & TECHNOLOGY SERVICES ITS- LLC. All rights reserved.” No other use of content, including, among others, any kind of reissue of it, is permitted without prior written authorization granted by “The Company”. Every user who has been proven to have violated the intellectual property of a third party by retransmitting or publishing material linked to this Utransfer that infringes copyright or other legal rights of that third party will be excluded from this Utransfer.
All registered trademarks used in Utransfer are the property of the Company or, in a few cases, used with the authorization of their respective holders. No third party may use or reproduce any trademark that includes, among others, logos and internet domains using the registered trademarks “INNOVATION & TECHNOLOGY SERVICES ITS- LLC” “Utransfer” (whether or not used with uppercase letters or spaces) without the prior written consent of the Company or the owner of the trademark.
Apart from the non-exclusive, non-sublicensable, non-transferable, personal or limited right of the Users as specified herein, no rights are conferred to such Content or portions thereof, regardless of how it appears, through its inclusion in Utransfer or through access to it by the User, unless there is prior written consent from the Company or the owner of the trademark. A User may not: (a) separate any individual content or component of Utransfer for any purpose other than related to the Utransfer, (b) incorporate a portion of it into the User's own programs or compile any portion in combination with the User’s own programs; (c) transfer it to be used by another service; or (d) sell, lease, assign, lend, distribute, publicly communicate, transform, or sublicense Utransfer or grant in any manner any right to Utransfer.
The Company reserves the right to amend, fully or partially suspend Utransfer occasionally. Likewise, the Company reserves the right to change the terms and conditions at any time, notifying the User with sufficient notice via email or text messages to the mobile number registered in Utransfer, with immediate effect from the moment Utransfer is updated. The terms “User” and “Users” refer to any individual or entity that uses, accesses, downloads, installs, obtains, or provides information from and to this Platform. All references to the plural in this document will include the singular, and references to the singular will include the plural unless another interpretation arises from context.
CLAIMS FOR VIOLATION OF RIGHTS IN UTRANSFER
In case a visitor believes that their intellectual property rights or trademarks may be violated by materials published or stored in Utransfer, they must notify a Rights Violation through our website or send an email to the following address [email protected].
USE
By using, accessing, downloading, installing, obtaining, or providing information from and to Utransfer, it is considered that Users have read and accepted these Terms and Conditions which are incorporated into this document.
Please note that all references from our Privacy Policy are also deemed valid whether the mobile application is used jointly or independently from the Company’s Website at www.its-llc.io
Users must cease the use of Utransfer immediately if they do not agree or do not accept all these Terms and Conditions. The Company reserves the right to remove or prohibit any User from using Utransfer at its sole discretion.
Additionally, the use of Utransfer is for individuals over eighteen years old under their consent. For this reason, the use of Utransfer is not authorized for minors under 18 years and is prohibited to register without the prior consent of their legal guardians.
USER ACCOUNTS
User accounts are restricted; the information provided by the client/user is for the exclusive use of the owners of Utransfer. Users will only have access to specific information and services for clients.
The Company is committed to creating a highly secure environment for its Users. Neither the user nor any individuals linked to them in any capacity may use the services of “Utransfer” or any tools offered by that platform for purposes contrary to the law, good morals, or ethics, remaining under the full responsibility of the user. For the effective use of the program, the user must respect the terms of use and follow the procedures outlined in the Utransfer
USER REGISTRATION
The use of “Utransfer” allows one to verify online all information provided by the user and helps manage the created account, demanding, among other requirements, authorization for the use of Utransfer and the assignment of the respective User keys. To be authorized as a user, it is necessary to comply with the application process by sending the respective user data. The user will be solely responsible for managing the individual keys, as well as the securities in place for obtaining and using said keys. Accesses and inquiries made through any of the keys granted to the User and by this means to the personnel under their responsibility will be automatically considered by “The Company” as coming from the same User and/or authorized by them.
Thus, the User is obliged to notify “The Company” in writing, by the fastest means possible, of any event that may lead to the unauthorized use of any of the keys that allow access to the service, regardless of how the obtaining and/or authorization for the provision of the corresponding key occurred or may eventually occur. Notwithstanding, this obligation, the User will solely be responsible for compensating for any damage caused by the unauthorized use of the security keys, without prejudice to the actions of recourse that they reserve against whoever is responsible for the unauthorized use that has generated such damages.
Once authorization is obtained, the User accepts these terms of use until they are withdrawn from the system on their own volition or by “The Company”’s decision in accordance with these conditions.
The Company reserves the right to accept or deny a user authorization. It also reserves the right to withdraw the granted authorization, temporarily or definitively block the user's access, when misuse is carried out by them regarding the tools provided by the Utransfer in accordance with these terms and conditions. The User reserves the right to voluntarily cancel the registration and authorization granted for which they must notify “The Company” electronically for the total or partial blocking of the account, without this implying the reimbursement of any amount paid for the service.
INFORMATION SERVICE
Users will be able to access the registered information and can access such information and the service provided through the Internet, 99% of the 365 days of the year while the subscription is in effect.
TECHNOLOGICAL SECURITY
The Company keeps its systems protected, for which it uses appropriate technology to provide the service, so although “The Company” will make its best efforts to maintain the security of Utransfer. The User accepts the contingency that any electronic correspondence sent within the scope of the service contracted with “The Company” may be captured and/or intercepted by third parties, when it travels between the user and Utransfer, whether through the Internet, or through telecommunications means and networks, telephones or any other electronic means.
When the User uses the electronic payment means “credit card” to conduct transactions, payment for services and purchases available in “Utransfer” by entering the information related to the credit card and proceeding with the corresponding payment, “The Company” will not be responsible if the information from the electronic payment means is captured and/or intercepted by third parties. The misuse of such payment means will not be the responsibility of “The Company”; the complaints, lawsuits, or claims will be made by the affected User before the competent authorities.
THIRD PARTIES
The wireless service providers of the Users, in which the User downloads, installs, uses, or accesses Utransfer, the creator of the operating system for the Users’ mobile devices and the operator of any application store or similar services through which users obtain Utransfer, if any exist, integrators with gaming, rewards, or payment service providers (collectively, the “Third Parties”) are not part of these Terms and Conditions and are not owners or responsible for Utransfer. Third Parties do not provide any warranty regarding Utransfer. They are not responsible for maintenance or other technical support services for Utransfer and will not be liable for any other claim, losses, imputations of responsibilities, damages, costs, or expenses related to Utransfer.
Users acknowledge and agree that Third Parties and their subsidiaries are third-party beneficiaries of these Terms and Conditions and that they have the right (and it will be assumed that they have accepted such right) to enforce these Terms and Conditions against users as third-party beneficiaries.
Users acknowledge and agree that Third Parties have their own terms and conditions that must be considered and accepted at the time of interacting with them. Users should use their own judgment regarding the adequacy and appropriateness of the information.

Utransfer uses Novus Loyalty as a rewards provider which helps us present benefits to our users. You can find their Terms and Conditions at the following link: https://www.novus-loyalty.com/terms-and-conditions.
Utransfer was created with the latest version available in the mobile device operating systems market, and compatibility issues may arise when using older versions. The coverage of the wireless network and the speed of the Wi-Fi network vary according to the provider and geographic location. The Company is not responsible for any limitations and/or failures in the operation of any wireless or Wi-Fi service used to access Utransfer nor for the security of wireless or Wi-Fi services. Likewise, “The Company” is not responsible for charges or tariffs for the use of data networks, which are the sole responsibility of the User.
PRIVACY POLICIES
By accepting the terms and conditions, the user freely and expressly authorizes “The Company” to collect and store information through Utransfer as described in the ORGANIC LAW ON PERSONAL DATA PROTECTION of Ecuador Chapter 1 SCOPE OF INTEGRAL APPLICATION, Article 4.
Consent may be revoked at any time without the need for justification. The processing carried out before revoking consent is lawful, as it has no retroactive effects.
As established by the Organic Law on Personal Data Protection of Ecuador in its article 8.
“The Company” guarantees the confidentiality of the services provided to the User through Utransfer. The most recent version published will always prevail. The information generated from Utransfer will be used exclusively by “The Company” to create greater functionalities of the services it provides. Likewise, to promote its users, thus allowing its customer base to form a community of resources available to all who comprise it. “The Company” does not distribute or share email addresses with its Users unless it has the express authorization of each of them. “The Company” does not disclose to third parties the information provided by the User for its process, unless the need to do so arises from an order by a competent authority. Each user will be responsible for maintaining the confidentiality and security of their access keys and about the information that the portal obtains or uses.
“The Company” may also collect or store certain information about visitors to Utransfer and/or Users of the service it provides, such as their Internet addresses (IPs) among other data. This information will serve to diagnose potential problems in the administration tasks of Utransfer, in order to constantly improve the quality of the service offered. Likewise, “The Company” may monitor and analyze usage statistics and download volume of Utransfer and its resources and share usage/download/visit statistics with third parties.
USER OBLIGATIONS:
1. Enter accurate and complete information when registering as a User and at the time of performing a transaction;
2. Upon proceeding with a transaction, enter real and complete data of the electronic payment means that will be used for the transaction;
3. Maintain absolute control of the assigned keys and access records correctly, being responsible for any inappropriate use of them;
4. Timely update Utransfer when required by the system, so that it works correctly; and,
5. Report any inconvenience immediately to “The Company”.
UPDATES OF Utransfer
The Company may request Users to update their version of Utransfer at any time. Although all efforts will be made to retain Users' personal settings and preferences, there remains the possibility that they may be lost.
WIRELESS COVERAGE ISSUES AND DISABLEMENT OF FUNCTIONS
When attempting to carry out a transaction in Utransfer, or on the webpage it is possible that the wireless connection may be interrupted or that a function is disabled. In the event that this occurs, Users should verify the status of the transaction attempted as soon as they enter an area with wireless coverage or have access to a computer. Users can also contact a customer service representative of “Utransfer or via email: [email protected].
RESPONSIBILITY OF THE PARTIES
User Responsibilities
1. Accurate Information:
The user is responsible for providing accurate and updated information during registration and when performing transactions. This includes personal data, banking information, and details of the recipient.
The user must immediately notify any changes to their information.
2. Appropriate Use of Utransfer:
The user agrees to use Utransfer in accordance with applicable laws and the established terms and conditions.
Use of Utransfer for illegal, fraudulent, or unauthorized activities, including money laundering and the financing of terrorism, is prohibited.
The user is responsible for maintaining the confidentiality of their access credentials and for protecting their mobile device or computer against unauthorized access.
3. Knowledge of Transactions:
The user must carefully review the details of each transaction before confirming it.
The user is responsible for verifying the accuracy of recipient information, the amount, and the currency of the transfer.
The user understands and accepts the risks associated with international transfers, including fluctuations in exchange rates and possible delays. “The Company” will make every effort to ensure that this transfer complies with regulations similar to data protection laws in the region where transferred, however, it disclaims any liability for any gap or difference that exists.
4. Compliance with Laws:
The user agrees to comply with all applicable laws and regulations related to international transfers, including exchange control laws and tax regulations.
The user is responsible for declaring and paying applicable taxes on transactions conducted through Utransfer.
5. Notification of Problems:
The user must immediately notify Utransfer of any unauthorized transaction, error, or technical issue.
Protection of Credentials:
The user is solely responsible for the security and confidentiality of their access credentials (username, password, PIN, etc.).
The user agrees not to share their credentials with third parties and to take precautions to prevent unauthorized access to their account.
It is strongly recommended to use strong and unique passwords and to enable two-factor authentication (2FA) when available.
Detection and Notification of Suspicious Activity:
The user must regularly monitor their account activity and promptly notify Utransfer of any unauthorized transaction or suspicious activity.
The user must be alert to potential phishing, smishing, or vishing attempts, and avoid providing personal or financial information in response to unsolicited requests.
Awareness of Fraud:
The user must inform themselves about the risks of fraud and scams online, and take precautions to avoid becoming a victim.
The user should be wary of unexpected money requests, offers too good to be true, and communications from unknown senders.
Responsibilities of The Company
1. Security of the Utransfer:
“The Company” is committed to implementing appropriate security measures to protect user information and ensure the security of transactions.
“The Company” must comply with data security standards and applicable regulations concerning the protection of personal information.
2. Processing Transactions:
“The Company” is committed to processing transactions in a timely and efficient manner, according to established deadlines.
“The Company” must provide the user with clear and accurate information about the status of their transactions.
3. Customer Service:
“The Company” is committed to providing efficient and accessible customer service to resolve user inquiries and issues.
“The Company” must respond to user notifications about unauthorized transactions, errors, or technical problems in a timely manner.
4. Compliance with Laws:
“The Company” is committed to complying with all applicable laws and regulations related to international transfers, including exchange control laws and anti-money laundering regulations and the financing of terrorism. “The Company” will make every effort to ensure that this transfer complies with regulations similar to data protection laws in the region where transferred, however, it disclaims any liability for any gap or difference that exists.
“The Company” must implement "Know Your Customer" (KYC) and "Customer Due Diligence" (CDD) procedures to verify the identities of users and prevent illegal activities.
5. Transparency:
“The Company” is committed to providing clear and transparent information about fees, exchange rates, and timing of transactions.
“The Company” must inform the user about any changes to the terms and conditions of Utransfer. As required by the Organic Law on Personal Data Protection of Ecuador.
6. Monitoring and Detection of Fraud:
The company will implement monitoring systems to detect and prevent fraudulent activities, such as unusual or suspicious transactions.
The company reserves the right to suspend or block accounts if suspicious activity is detected.
7. Authentication and Verification:
The company will implement authentication and identity verification procedures to ensure the security of transactions.
This may include two-factor authentication (2FA), biometric verification, and other verification methods.
8. Response to Security Incidents:
The company will establish procedures to respond to security incidents, such as data breaches or fraud.
The company will notify affected users in the event of a security incident that may compromise their information.
9. Regulatory Compliance:
The company will comply with all relevant regulations regarding the prevention of money laundering and the financing of terrorism.
LIMITED LIABILITY
Third parties, “The Company”, its parent and affiliate companies, along with their respective Directors, Representatives, Personnel, employees will not be liable nor subject to legal action, and hereby the User waives all claims, demands, liability imputations, legal action, complaints, claims for damages, due to, among others, direct, indirect, incidental, consequential, circumstantial, extraordinary, special, or punitive damages of any nature with respect to Utransfer (including all products, services, and content of the parties), even when the parties have been warned of the possibility of such damages. The only recourse of Users against such claims, demands, imputations of liability, legal actions, complaints, or claims for damages of Users against such claims, demands, imputations of liability, legal actions, complaints, or claims for damages is to cease the use of Utransfer.
ADVERTISING
Any advertising or promotional activity through Utransfer not carried out within the framework of the service use, including registration, payment, delivery of products, or provision of a service, or any other obligation related to such activities, will be the sole responsibility of the parties involved, so “The Company” will have no liability arising from such promotional activities, or from the presence of advertisers in Utransfer and/or in the provision of the service.
PRIVACY
Our privacy policy regarding any information obtained by The Company through Utransfer can be consulted in the Privacy Policy section of the Company’s Website. Some additional rules regarding privacy may be valid as established in the restricted functionalities of Utransfer for specific User services.
The use of Utransfer involves the electronic transmission of information through the wireless service provider's networks. Since the Company does not operate or control the wireless networks used to access Utransfer, The Company is not responsible for the privacy or security of wireless data transmissions. Users should use accredited service providers and verify with their wireless service provider the information regarding their privacy and security practices.
SPONSORSHIP
The Company does not recommend, sponsor, or promote third-party businesses, services, or products, except for expressions of recommendation or sponsorship that The Company makes expressly, if any, in Utransfer. If Utransfer provides information about third parties or provides third-party content, and even links to third-party websites, “The Company” will not be liable for any damage or prejudice related to any third-party information, even if it contains errors or mistakes. Likewise, the Company will not be responsible nor subject to legal action for third-party services or products. Please also refer to the section regarding links in our Privacy Policy, including the disclaimer for third-party content.
DISCLAIMER OF WARRANTY
The parties make no representations regarding the functionality and use of the content of Utransfer. The use and navigation that the User does with Utransfer is at the User's own risk. All information contained in Utransfer is provided “As Is” and “As Available” without representations or warranties, whether express or implied.
Users should not assume that the information included in Utransfer is constantly updated or includes recent information.
Utransfer may stop functioning, be interrupted, or function improperly occasionally. The exempt parties have no responsibility for such cessation of functionality, interruption, or improper functioning. Users are warned that the information contained herein may contain technical errors, inaccuracies, programming errors, unknown viruses, and omissions. The User assumes all risks associated with the use of Utransfer, and agrees that “The Company” waives all warranties related to the use of Utransfer by the User.
Notwithstanding anything provided in any other clause of these terms and conditions, “The Company” disclaims all representations or warranties, whether express or implied, of any kind regarding Utransfer (including our products, services, and site content) including, among others, warranties of merchantability and fitness for a particular purpose, peaceful enjoyment, title, non-infringement of third-party rights, and accuracy. No information or Oral or Written Advice given by us or our authorized representatives will create a warranty or increase in any way the scope of our obligations as set forth in these terms and conditions
RELEASE
Users will release and exempt the Exempt Parties from all claims, demands, civil liability, legal action, complaints, or damages (including reasonable attorney's fees and expenses) that arise as a result of the use that such Users make of Utransfer (including our products, services, and Content), including, among others, incorrect information, content or delivery of Utransfer, or of The Company’s or third-party products and services such as integrations with rewards companies, identity verification, payment gateways, electronic or mechanical equipment failures; communication line failures; interconnection problems; “bugs” errors, configuration issues or incompatibilities in mobile devices, and/or their programs; failures or interruptions of Internet access; issues with internet service providers or any equipment or service related to the mobile device or computer resulting from the use of Utransfer or the Service. “The Company” reserves the right, on its behalf, to assume the exclusive defense and control of any matter subject to release by Users, but doing so does not exempt Users from their release obligations.
AVAILABLE LOCATION FUNCTIONS
Certain location functions available in Utransfer are provided by third parties. The use that users make of that functionality is subject, to the terms and conditions of the third party (and to their occasional updates). Users should use their own judgment on the adequacy and suitability of the information. All location information is provided entirely on the conditions it exists, without warranties of any kind.
HYPERLINKS (“ LINKS”)
“The Company” through Utransfer and/or during the application of the service may directly provide or through third parties, links to other portals or resources on the Internet.
As such, “The Company” assumes no responsibility for the content, promotion, availability, or permanence of such portals and resources, nor for any potential damages or losses arising therefrom.
APPLICABLE LAW AND DISPUTES
By using, accessing, downloading, installing, obtaining or providing information from and to Utransfer, Users expressly agree that any claim, dispute or legal controversy between Users and “The Company” that arises or is linked in any way to Utransfer, including disputes related to the applicability, scope or validity of any of the clauses of these terms and conditions or our privacy policy (jointly “Disputes”) will be resolved according to the procedures established herein, any party may submit a claim against the “Company”.
This contract will be governed by its own clauses, and in the absence of self-regulations, it will adhere to the ordinary application rules in contractual relationships of E-Commerce.
In matters of intellectual property, it will be governed by the standards contained in the current international agreements, any controversy between the parties, the User agrees to resolve disputes by resorting to mediation or, failing that, to legal arbitration of the Arbitration and Mediation Center of the Chamber of Commerce of Guayaquil.
- Arbitration Tribunal: each party will choose an arbitrator from the list of the selected center, and a third will be appointed by drawing from the same list.
- Waiver of collective arbitration: to the extent that the full application of the laws permits, all Disputes will be resolved through binding confidential arbitration individually according to each party's individual capacity, and not as part of a supposed class action or any collective legal action. The arbitrator does not have the legal capacity to resolve more than one person's claim, and cannot resolve in any way any form of representative or collective legal action. Users expressly agree that no other Dispute will be unified or annexed to their Dispute, whether through collective arbitration legal actions or other proceedings. By using, accessing, downloading, installing, obtaining or providing information from or to Utransfer, Users agree that they voluntarily and deliberately waive any right to participate as a representative or member of any group or collective of claimants of any Dispute.
- Compliance with the arbitration decision: the arbitration decision will be final and binding for all parties subject to these Terms and Conditions. The ruling of the Arbitration Court will have the effect of Res Judicata. Consequently, the parties waive submitting conflicts to the judges of the judicial function. The parties also agree that the arbitration process may in no case exceed 150 days.
- Precautionary Measures: the parties authorize the arbitrators to issue the precautionary measures necessary to guarantee the outcome of their rulings, for which they are empowered to request assistance from public officials and authorities that are necessary.
All costs, fees, expenses, etc., arising from the intervention of the aforementioned Arbitration and Mediation Center will be borne by the losing party.
DIVISIBILITY
If any clause of these Terms and Conditions is found to be invalid, null, or unenforceable, the remaining clauses will retain their full validity in any case and the invalid, null, or unenforceable clause will be considered modified in such a way that it is valid and enforceable to the maximum extent permitted by law.
ADDITIONAL TERMS FOR APPLE DEVICES
This section applies exclusively to Users using Utransfer on an Apple device (for example, iPhone, iPad, iPod Touch) (hereinafter referred to as “Apple Device”). The Company is solely responsible for Utransfer that you use on your Apple Device, and Users may use Utransfer on their Apple Device only as permitted in these Terms and Conditions and in the “Usage Guidelines” established in the Terms and Conditions of the App Store http://www.apple.com/legal/itunes/appstore/us/terms.html. Regarding the disclaimer of liability between the Company and Apple Inc., to the extent that: (a) the Company must address any claim related to the use or possession by the User or a third party of Utransfer on the User’s Apple Device, and the company will be responsible for addressing, investigating, or defending the claim; and (b) the Company has not effectively waived any warranty related to Utransfer on the User’s Apple Device, it follows that the Company will be solely responsible concerning any product warranty or other claims, losses, liability imputations, damages, costs, or expenses if Utransfer does not conform to any warranties. If Utransfer on the User’s Apple Device does not conform to any warranties, the User may request Apple Inc. a refund for the sum of the purchase of Utransfer on the User’s Apple Device, if any. Apple Inc. will have no warranty obligations of any nature regarding the Utransfer on the User’s Apple Device. Apple Inc. and its subsidiaries are third-party immunities of these Terms and Conditions, and Apple Inc. and its subsidiaries may enforce these Terms and Conditions against Users as third-party immunities of these Terms and Conditions.
Account Closure
The User may cancel their account from Utransfer at any time and at no additional cost, and must settle any outstanding balance in the wallet account before taking this action.
PREPAID CARD ACCEPTANCE
By registering with Utransfer, the User is entitled to a prepaid card issued by Utransfer. By accepting and using the prepaid card, the User agrees to comply with the following conditions:
1. Objective
“The Company” grants the User a prepaid card that may be used to make payments and purchases within the limits of the available balance on it. The card is rechargeable, unless indicated otherwise, and its use is subject to the terms established in this contract.
2. Use of the Card
The User agrees to use the card responsibly and in accordance with the provisions of “The Company”. The card may only be used to make purchases of goods and services at establishments that accept this type of payment. The User must ensure that the available balance on the card is sufficient to cover the transactions they wish to make.
3. Associated Charges
The User acknowledges that the use of the prepaid card is subject to certain charges “The Company” may apply, which may include but are not limited to:
Charges for issuance and renewal of the card.
Charges for transactions made outside the ATM network of “The Company”.
Charges for balance or account statement inquiries.
Charges for inactivity if the User does not make transactions for a certain period. “The Company” agrees to inform the User about the applicable charges at any time through available channels.
4. User Responsibility
The User is responsible for the preservation and proper use of the card, as well as for maintaining the confidentiality of any PIN or password associated with it. In case of loss, theft, or unauthorized use of the card, the User must immediately notify “The Company” to suspend its use. The User will be responsible for any unauthorized use that occurs before the loss or theft is reported.
5. Limitation of Liability
“The Company” will not be responsible for unauthorized transactions made with the card unless the loss or theft has been reported within the timeframe established by the internal policy of the entity. “The Company” will also not be responsible for the denial or error in processing transactions by third-party providers.
6. Modifications and Termination
“The Company” reserves the right to modify the terms and conditions of this contract at any time, notifying the User in advance. The User may cancel the card at any time, subject to the conditions that “The Company” determines, and must settle any outstanding balance.
This contract will be governed by the laws of Ecuador, and any dispute will be resolved according to the procedures established by applicable legislation.
